    LCW and LCWRA for self-employed gig workers

    What it is

    Limited Capability for Work (LCW) and Limited Capability for Work and Work-Related Activity (LCWRA) are DWP classifications used on Universal Credit and ESA. They come out of the Work Capability Assessment (WCA). LCW means you are not well enough to work now but can do work-preparation activity. LCWRA means you cannot work and should not be pushed into work-related activity. LCWRA adds an extra element to UC and releases you from work-search conditions.     How it applies to you

    If you are self-employed on Uber, Deliveroo, Amazon Flex, Stuart or Just Eat and you become too sick to work, the WCA is what decides whether UC keeps paying, whether the Minimum Income Floor is switched off, and whether you move into the LCWRA group. DWP looks at physical and mental descriptors from the Social Security (Personal Independence Payment) Regulations 2013 and the UC regulations. A broken wrist that keeps you off for 10 weeks will not usually trigger LCWRA, but it can justify LCW and switching off the MIF while you are signed off. Long Covid that lasts over a year, or serious mental ill health, can justify LCWRA. For a 34 year old Amazon Flex driver with long Covid, earning about £700 a week before she got ill, the WCA decision is critical. LCWRA adds around £416.19 a month to UC in 2025-26 and removes most work-search rules. LCW does not add money but still switches off the MIF when you are signed off. You need GP fit notes throughout the assessment period. DWP commissions the assessment through a contractor and you can be asked to do it by phone, video or in person. You can appeal a WCA outcome through Mandatory Reconsideration and then to a First-tier Tribunal. Representation matters, tribunals overturn a significant minority of DWP decisions every year when evidence is presented properly.
